Terms of Service

Draft pending legal review. These terms describe how we intend the service to operate. They have not yet been reviewed by counsel and should not be relied on as a final legal document.

1. Agreement

By using Petfocial you agree to these terms. If you do not agree, please do not use the service. If you use it on behalf of an organization, you confirm you are authorised to bind that organization.

2. What the service is

Petfocial is an information service. We publish a directory of animal welfare organizations and programs, and we host reports that users file about animals they have found.

We are not a veterinary provider, an animal control authority, or an emergency service. Nothing on the site is veterinary, legal or financial advice. In an emergency, contact a veterinarian or your local animal control directly rather than filing a report and waiting.

3. Accuracy, and its limits

We work hard on the accuracy of the directory, and we show you the source and the check date for individual facts precisely so you can judge them yourself. Even so, programs change without notice, and organizations sometimes publish information that is out of date.

Confirm anything you are relying on directly with the organization, particularly prices, eligibility and opening hours. We provide the directory as-is and do not warrant that every entry is current or complete.

4. Your account

You are responsible for what happens under your account and for keeping access to it secure. Give us accurate information. One person, one account. You must be at least 13 years old, or the minimum age in your country if it is higher.

5. What you may not do

• File reports you know to be false, or use a report to harass a person.
• Post someone else’s personal information — an address, a phone number, a photograph of them — without their consent.
• Use the directory to send bulk unsolicited messages to the organizations listed on it.
• Scrape, bulk-download or resell the directory. Reasonable, attributed, non-commercial use is welcome; ask us and we will usually say yes.
• Attempt to break, overload, or gain unauthorised access to the service.
• Use the service to do anything unlawful or to cause harm to an animal.

6. Content you submit

You keep ownership of what you post. You grant us a non-exclusive, worldwide, royalty-free licence to host, display and distribute it for the purpose of running the service — which includes showing your report to organizations able to respond to it.

Only submit photographs you took or have the right to share. We may remove content that breaks these terms, and we may suspend accounts that repeatedly do so.

7. Organization listings

A listing is not an endorsement, a recommendation, or a warranty about the organization. Program listings are never eligible for paid placement. Where a commercial listing is promoted, it is shown in a separate section and marked as such.

If you represent a listed organization and something is wrong, or you want the listing removed, write to info@artifocial.com and we will act on it.

8. Interactions with organizations

Any arrangement you make with an organization you find here — an appointment, a fee, a trap deposit, an adoption — is between you and them. We are not a party to it and we are not responsible for the outcome.

9. Availability

We aim to keep the service running but do not guarantee uninterrupted availability. We may change or discontinue features. If we discontinue the service entirely, we will give account holders reasonable notice and an opportunity to export their data.

10. Liability

To the fullest extent permitted by law, Artifocial is not liable for indirect or consequential loss arising from your use of the service, or from your reliance on directory information you did not confirm with the organization. Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by our negligence, or for fraud.

11. Termination

You may close your account at any time. We may suspend or close an account that breaches these terms, and will tell you why unless we are legally prevented from doing so.

12. Changes to these terms

We may update these terms. For material changes we will notify account holders and update the date above. Continuing to use the service after a change means you accept it.
